While no two cases or collaborative professionals are alike, the emphasis in the approach is to find a way in which the professionals can work together with the parties that will achieve a satisfactory settlement in an efficient, cooperative manner.

In the event the parties are unable to arrive at a settlement through the collaborative- law approach, the collaborative professionals withdraw from the case and the parties are free to retain trial attorneys to pursue their matter in Court.

Collaborative divorce and mediation both aim to resolve disputes respectfully and outside of court, but they differ in structure. In mediation, a neutral mediator helps the couple reach agreements directly.

In collaborative divorce, each person has their own collaboratively trained attorney, and the couple works together with a professional team—often including financial and mental health professionals—to reach a mutually beneficial settlement.

Collaborative mediation blends elements of both mediation and collaborative law. A neutral mediator facilitates discussions while each spouse has access to collaboratively trained professionals—such as attorneys, financial experts, or communication coaches—who offer support and guidance.

The goal is to reach thoughtful, respectful agreements together without going to court.
